Duminda Silva becomes a victim

An attempt is being made to make UPFA MP R. Duminda Silva, who is the main suspect in the murder of Bharatha Lakshman Premachandra, the victim in the case, Lanka News Web learns.

The CID report to be handed to courts at the next hearing states that Duminda Silva is unable to comprehend anything that is read to him and cannot respond as a result and his memory has been affected to great extent that he is unable to remember anything. The report is to also note that he is suffering from great mental distress and is mentally incapacitated for the rest of his life.

The CID is to inform court that R. Duminda Silva could not be investigated since he cannot be interrogated and a statement could not be recorded. Also, since the evidence does not indicate Silva to be a suspect in the murder, the CID is to ask court to consider him a victim after handing over all Silva’s medical reports.

The state counsel appearing in the case and President’s Counsel Hemantha Warnakulasuriya appearing for Silva have come to an understanding and the Attorney General’s Department has handed over copies of documents related to the case without receiving proper court approval to Warnakulasuriya.

When the case was taken up for hearing the last time, a warrant was issued on IP Merrill Ranjan Lamahewa who is heading the investigation into the murder for failing to appear in court. Lamahewa had been at the lawyers’ canteen with Warnakulasuriya drinking a cup of tea.

After the President’s Counsel had explained the situation to the Magistrate, the warrant had been recalled.
